Wills & Estate Planning
Roundtree Tarpey Solicitors | Dublin
We are highly experienced in providing comprehensive advice on all matters required to make a Will with clarity and precision. We always emphasize the importance of planning ahead in order to ensure as much control as is practical over future events.
We review your family circumstances, if there is a need to consider guardians for minor children, your assets, the appointment of your executors, and trusts. After providing you with expert advice on the entire process, we draft your Will to reflect your circumstances.
The drafting of a Will is an often-deferred task, but the importance of making a Will cannot be overstated. If you do not make a Will then on your death your assets will be distributed according to the Rules of Intestacy rather than according to your wishes and those Rules may differ greatly from how you might otherwise prefer to distribute your estate, appoint your executors, or appoint guardians for your children.
Your Will should be reviewed regularly, particularly when your circumstances change. For example:
-
Many people do not realise that entering into a marriage or a civil partnership will automatically revoke an otherwise valid Will. If you do not make a new Will your estate must then be distributed according to the Rules of Intestacy.
-
Separation or divorce does not revoke a Will and your spouse will not automatically lose their right to a legal right to a share of your estate. This may be governed by the terms of a separation or judicial separation agreement, or divorce.
-
The birth of a child gives rise to the need to prepare a Will, or to change your Will, to provide for your child and to appoint trustees and guardians for your child.
-
Where the death occurs of your spouse, partner or any other beneficiary contemplated by your Will.
-
Where your assets may have altered significantly in value, or where you have disposed of or acquired an asset and you wish to deal with it in your Will.
-
Any relevant changes in tax law.
